ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at time of entry and who are registered members of Rivals.com. Registration is free and is further described below. Employees, officers, and directors of JBS Sports, Inc. d/b/a Rivals.com ("Sponsor"), its parent, subsidiaries, divisions, affiliates, co-venturers, advertising and promotion agencies ("Sponsor and its agents") NCAA coaches, student athletes and administrators, and the immediate family members (spouses, siblings, children, and parents, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible. Bracket Battles is subject to all federal, state and local laws, and is void in Puerto Rico, all U.S. territories and possessions and wherever prohibited by law.
PROGRAM DESCRIPTION: Rivals.com Bracket Battles ("Bracket Battles") is a competition based on results of the 2007 Division I Men's College Basketball Tournament (the "Tournament"). On March 11, 2007, the NCAA Tournament selection committee will seed the qualifying college basketball teams and announce the Tournament field. Bracket Battles contestants will be asked to select the winners of all the Tournament games (with the exception of the March 13, 2007 play-in game for the 64th slot in the Tournament field) by completing a Tournament bracket at Rivals.com. Bracket Battles Tournament Selections can be made and brackets completed during the Contest Period, which begins on March 11, 2007 following the Tournament selection process and ends two hours prior to tip-off of the first game on March 15, 2007.
The Sponsor will serve as the administrator for Bracket Battles and will be responsible for resolving any disputes that arise. Participation in Bracket Battles constitutes the entrant's full and unconditional agreement to these Official Rules and to Sponsor's decisions, which are final and binding in all matters relating to Bracket Battles.
GAMBLING PROHIBITION: Bracket Battles is strictly for entertainment purposes and may not be used in connection with any form of gambling.
TO PLAY: If you are not already a registered user of Rivals.com, go to www.rivals.com or www.bracketbattles.rivals.com and follow registration directions. You will be asked to provide your name, complete address, age and e-mail address, and to select a user name and password. You will also be asked to consent to receive promotional emails or offers. Consenting to receive promotional emails or offers is optional and does not have to be agreed to in order to become a member or to win a prize.
After logging in to the system with your username and password, you will have access to an on-line brackets page listing the 64 eligible Tournament teams and their round one match-ups. (Note: The 64th team will be determined by a play-in game on Tuesday, March 13, 2007. That game will not be counted in this contest.) You must enter your projected winners of all 63 Tournament games (not including the March 13, 2007 play-in game for the 64th slot in the Tournament field), round by round.
The first bracket you complete during the Contest Period will become your "Contest Bracket" and will be your entry in the One Million Dollar Prize competition and the Network Plasma TV competition. You may edit your Contest Bracket up until two hours prior to tip-off of the first game on March 15, 2007. After that, no more editing is allowed and all Contest Brackets are final. There is a limit of one Contest Bracket per registered user. No brackets filled out for league competition other than the Contest Bracket will be included in competition for prizes. Incomplete brackets not be included in competition for prizes.
All contestants whose Contest Brackets correctly predict the winners of all 63 Tournament Games (according to official NCAA results) will equally and ratably share the One Million Dollar Prize (as defined below). Contestants will also receive points in the Network competition based on their Contest Bracket being scored according to the scoring system described in Section 5. The contestant with the highest total score after the championship game currently scheduled for April 2, 2007 wins the Grand Prize (as defined below).
ALL POTENTIAL WINNING BRACKETS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A CONTESTANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL CONTESTANT'S ELIGIBILITY AND THE POTENTIAL WINNING BRACKET HAS BEEN VERIFIED AND CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.
NETWORK COMPETITION SCORING: You will receive a fixed number of points for each correct pick on your Contest Bracket, with the point value of a game increasing as you progress through the Tournament:
10 points for each correct pick in the first round
20 points for each correct pick in the second round
30 points for each correct pick in the third round
40 points for each correct pick in the fourth round
50 points for each correct pick in the semifinals
60 points for correctly picking the winner of the national championship game
The participant whose Contest Bracket earns the highest total score in the network competition after the championship game wins the Grand Prize described in Section 6. In the event of a tie, the winner will be the user who correctly predicted the winning team in the national championship game and was closest to predicting the actual score of that game, based on the absolute value difference between that user's prediction and the actual score for the two teams. In the event a tie still exists, the winner's name will be randomly drawn from among the names of all participants tied with the highest total score plus the tie-breaker.
PRIZES: One (1) Grand Prize – 50" High Definition Plasma Television, approximate retail value $5,000.
One Million Dollar Prize - All contestants in the network competition who correctly predict the winners of all 63 Tournament games (according to official NCAA results and not including the March 13 play-in game) will equally and ratably share One Million Dollars ($1,000,000). The One Million Dollar ($1,000,000) prize will be paid in equal installments of $25,000 per year over forty (40) years without interest. Total payments shall equal $1,000,000. If no contestant correctly predicts the winners of all 63 Tournament games, the One Million Dollars will not be awarded.
Approximate Retail Value of all Prizes: $1,005,000.00.
Potential winners will be notified by email, phone, postal mail and/or express mail at Sponsor's sole discretion. If a potential winner fails to respond within 10 days of the date the Sponsor's notification attempt was initiated, the prize will be forfeited. Potential winners will be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If a potential winner is 18 or older, as is required for entry, but not of the age of majority in state of residence, prize will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner.
Prizes are not transferable or refundable and must be accepted as awarded. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, in which case a prize of comparable or greater value will be awarded. Sponsor makes no representations or warranties about the prizes. The odds of winning any prize depend on the relative performance of all participants.
GENERAL: Prize recipients are responsible for all federal, state and local taxes and expenses not specified relating to acceptance and use of a prize. By participating, entrants agree to release, discharge, and hold harmless Sweepstakes Entities (collectively, "Releasees") from any and all injuries, liability, losses, and damages of any kind resulting either directly or indirectly from their participating in the game or the acceptance, use, or misuse of a prize including, without limitation, personal injury, death, and property damage. By accepting a prize, winners grant Sponsor the right to use their names, voices, likenesses, statements, any biographical information they provide, and/or photographs without notice, review, or approval; and to the announcement/use of their names, voice, image, and/or likeness for trade, advertising, publicity, and promotional purposes without compensation (unless prohibited by law) by Sponsor and those acting pursuant to Sponsor's direction, in each case in all media now known or hereafter discovered, worldwide, including but not limited to the World Wide Web, without notice, review, or approval and agrees to execute specific consent to such use if asked to do so. Releasees are not responsible for and shall not be liable for: [a] lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified; [b] any unavailability of or interruptions to any service or equipment used in connection with Bracket Battles including, without limitation (i) interruptions to any network, server, Internet website, telephone, satellite, computer or other connections, (ii) failures of any telephone, satellite, hardware, software or other equipment, (iii) garbled, misdirected or jumbled transmissions, or traffic congestion, (iv) other errors of any kind, whether human, technical, mechanical or electronic, (v) the incorrect or inaccurate capture of entry or other information or the failure to capture any such information, or [vi] any condition caused by events that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend Bracket Battles and limit entries to those legitimately submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion; and in event of any cancellation, suspension or termination notice thereof will be posted on www.rivals.com.
Sponsor may, in its sole discretion, prohibit any participant from using the Rivals.com Website or participate in "Bracket Battles", and refuse to award points or prizes if participant engages in any conduct Sponsor deems to be improper, unfair, detrimental, unsportsmanlike, or otherwise adverse to the operation of the websites, game or other participants. Use of any automated system (e.g., robots, automatic, macro, programmed or like entry methods) is prohibited. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Internet entry must be made by the entrant only at the authorized Web site address. Entries may not be made by any other individual or any entity, and/or originate at any other Internet Web site or e-mail address, including but not limited to commercial contest subscription notification and/or entering service sites. Any potential winner who enters by any of the methods described above will be disqualified. Once submitted, entries become the sole property of Sponsor and will not be acknowledged or returned. In the event of a dispute as to any entry, the authorized account holder, i.e., natural person, of the email address used to register will be deemed to be the registrant. Potential winners may be required to show proof of identification. Sponsor may require that the potential winner provide proof that he/she is the authorized account holder of the email address and/or password associated with the winning entry. Sponsor's decisions are final and binding.
This Agreement shall be governed pursuant to the laws of the State of Tennessee. Venue shall be in Williamson County or Davidson County, Tennessee (at the sole discretion of Rivals) for any and all cases arising out of the use of the Rivals network and/or regarding content, games, or any other feature or promotion of the Rivals network. By using this site, registering on this site, or subscribing to this site, you agree to all of these terms and Rivals.com's terms of service, which are incorporated herein by reference (collectively, the "Terms").
PRIVACY: Personally identifiable information that is submitted by entrants as part of this game will be used to administer the game, select prize winners and fulfill prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.rivals.com. Such information will not be used for any other purposes than as stated in these rules or as separately accepted by you.
WINNER LIST: The winner list will be posted at www.rivals.com on or about April 9, 2007, and will be available for a period of two weeks.
